Florida Supreme Court To Review Engle Decision
Philip Morris USA Will Urge Court To Affirm Decertification Order
NEW YORK (May 12, 2004) -
The Florida Supreme Court announced today that it will review a decision by the states intermediate appellate court in the Engle case. The court gave no reason for its decision.
Each side now will be asked to submit legal briefs in support of their positions, and arguments are scheduled for October 6, 2004 in the Florida Supreme Court.
The company is optimistic that the Supreme Court, once given the opportunity to carefully review the case, will conclude that the intermediate appellate court correctly interpreted Florida law in reversing the Engle decision.
